Driving licence withdrawal: duration by severity

Three categories of offence

The Road Traffic Act distinguishes between minor (art. 16a LCR), medium (art. 16b LCR) and serious (art. 16c LCR) offences, according to the degree of danger to road safety and the driver's fault. This classification directly determines the applicable administrative consequences.

The minor offence

A minor offence in principle results in a simple warning, unless the driver has already had a licence withdrawn or received a warning in the previous two years, in which case a withdrawal of at least one month is ordered (art. 16a LCR).

The medium offence

It results in a licence withdrawal of at least one month (art. 16b LCR). In the event of a repeat offence within the periods set by law, the minimum withdrawal period increases progressively.

The serious offence

A serious offence, such as qualified drink-driving or a significant speeding violation, results in a licence withdrawal of at least three months (art. 16c LCR). In the event of repeated offences, the law provides for increasing minimum periods, which can go up to withdrawal for an indefinite period on safety grounds.
